These Terms and Conditions govern the use of the real estate crowdlending platform operated by Capivorium S.A.S. By accessing and using our website, you accept these terms in their entirety. If you do not agree, please do not use the platform.
1. Definitions
"Platform" refers to the website capivorium.com and all its associated services. "User" refers to any person who accesses the Platform. "Investor" refers to a registered User who participates in crowdlending projects. "Project" refers to each real estate investment opportunity published on the Platform. "Developer" refers to the party responsible for executing the real estate project.
2. Eligibility
To use the Platform as an Investor, you must: be over 18 years of age; reside in the Argentine Republic or have legal authorization to invest in the country; provide truthful and up-to-date information; comply with current CNV (National Securities Commission) regulations applicable to collective financing.
3. Registration and account
By registering, you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your access credentials. Capivorium reserves the right to suspend or cancel accounts that violate these terms or show signs of fraudulent activity.
4. Service description
Capivorium operates a real estate collective financing (crowdlending) technology platform that connects investors with development, construction, renovation or property enhancement projects in Argentina. Capivorium acts as a technology intermediary and does not directly manage real estate projects. The Platform facilitates the analysis, selection and monitoring of investments, but does not guarantee the profitability or success of any project.
5. Investment risks
Investing in real estate crowdlending carries significant risks, including: total or partial loss of invested capital; delays or defaults in project timelines; fluctuations in real estate asset values; regulatory risks and changes in applicable regulations; illiquidity risk of not being able to access funds before project maturity. Each Investor is responsible for evaluating risks and making their own investment decisions. The information presented on the Platform does not constitute financial, legal or tax advice.
6. Fees and commissions
Applicable fees for each project are transparently detailed before confirming the investment. Capivorium may charge commissions for platform management, which will be previously disclosed. Costs associated with bank transfers or taxes are the Investor's responsibility.
7. Intellectual property
All content on the Platform, including texts, graphics, logos, images, software and design, is the property of Capivorium S.A.S. or its licensors. Its reproduction, distribution or modification without express authorization is prohibited.
8. Limitation of liability
Capivorium shall not be liable for direct, indirect, incidental or consequential damages arising from the use of the Platform or investment decisions made by Users. We also do not guarantee uninterrupted availability of the Platform or the absence of technical errors.
9. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Argentine Republic. For any controversy arising from the use of the Platform, the parties submit to the jurisdiction of the Commercial Courts of the Autonomous City of Buenos Aires.
10. Modifications
Capivorium reserves the right to modify these Terms and Conditions at any time. Changes will be notified through the Platform at least 15 days in advance. Continued use of the Platform after notification implies acceptance of the new terms.
